国际私法上的意思自治原则

摘 要

意思自治原则是国际私法的基本原则。在本文中，文章对该原则在国际私法中的基本理论，即内涵、历史发展及其规律作了较为深刻的分析，从而揭示了其本质。另外，对意思自治的'适用领域及其运用实施的情况进行了介绍，尤其对意思自治原则在我国私法实践中存在的问题的提出及完善建议是值得进1步探讨的。

Abstract

 Principle of the autonomy of will is the basic principle in  International Private Law. The article mainly deals with the fundamental meaning and development of the principle, and uncovers its essence.This article only makes some brief remarks about the applicability of the party autonomy in the International Private Law,especially deals with application and limits of the principle and the legislation and its perfection in china.
