波斯纳的法律经济学思想评析
摘要
波斯纳是法律经济学理论的集大成者和主要代表人物。在本文中，笔者从法律经济学的兴起与发展这个大背景出发，论述了波斯纳法律经济学思想的核心、理论基础和他对1些具体法律的经济分析，并对其法律经济学思想进行了评价。笔者主要评析了波斯纳法律经济学效益理论的价值和对我国社会主义市场经济条件下法制建设的借鉴意义，同时也分析了他这1理论的缺陷与不足。总的来说，波斯纳法律经济学思想的价值远远大于其局限性，最重要的是他这1思想对我国目前的形势来说有着很重要的现实指导意义。

ABSTRACT
Posner is legal economic theory collection accomplishing and the mainrepresentative personage. In this article, the author with developedthis big background from legal economic starting to embark, elaboratedthe Posner law economic thought core, the rationale and he to someconcrete legal economic analyses, and has carried on the appraisal toits legal economic thought. The author has mainly evaluated the Posnerlaw economic benefit theory value and to our country socialist marketeconomy condition under the legislative work model significance,simultaneously has also analyzed his this theory flaw and theinsufficiency. Generally speaking, the Posner law economic thoughtvalue is bigger than its limitation by far, most importantly his thisthought to our country at present situation said has the veryimportant reality instruction significance.
