论我国的司法鉴定人委托制度
摘要
司法鉴定人的委托制度即司法鉴定的启动权和决定权问题，其包括鉴定事项的提出和鉴定人的选任，而其最重要的问题之1就是如何选任合适的鉴定人。英美法系国家1般采取当事人委托鉴定制度，大陆法系国家多采取司法官委托鉴定制度，我国的司法鉴定人委托制度其本上采取司法官委托制度。本文通过对两大法系司法鉴定委托制度的对比和思索，结合对我国司法鉴定委托制度现状的分析，针对我国目前的司法鉴定人委托制度存在的1些亟待解决的问题，从制定统1的司法鉴定法，赋予当事人1定的司法鉴定委托权，建立必要鉴定规则，建立共同鉴定制度等方面对我国司法鉴定人的委托制度提出1些完善建议。

ABSTRACT
The entrustment of judicial surveyor system, that is, judicial appraisal start right and the problem of power to make decisions, it includes appraisal item put forward and surveyor choose to take the charge, and one of the most important problems is to how to choose to take the charge of suitable surveyor . British-U.S. law department country adopts involved party normally to entrust appraisal system, Continent law department country adopts judiciary to entrust appraisal system, the judicial surveyor of our country entrusts system it to adopt judiciary on book to entrust system. In this thesis, I will compare and analysis judicial appraisal entrusting system of British-U.S. law department and analysis the present situation combining our country’s judicial appraisal entrusting system. According to the present problem of our country that judicial surveyor entrusts system to exist and to be urgently solves somewhat, the examination of this paper is from the judicial identification method of established unification, give involved party certain administration of justice to appraise entrustment right, establish necessary appraisal rule and common appraisal system for the judicial surveyor of our country system makes some perfect suggestions.
