论滩涂承包经营权的效力
摘 要
滩涂承包经营权,是指公民、集体依法对集体所有的、或者国家所有由集体使用的滩涂进行承包经营的权利。滩涂承包经营权的基本权利主要包括滩涂占有权、经营自主权、经营收益权及依法处分权等权能；基本义务主要包括不得随便改变滩涂农业用途、合理开发利用滩涂、滩涂不得抛荒及负有容忍国家征收等义务。我国现行法律对滩涂承包经营权的权利与义务规定还有1些不足，立法机构应从以下几方面完善我国滩涂承包经营权制度：规范滩涂所有人的行为；对公共利益进行界定；健全补偿机制；对滩涂承包经营权权利的行使加以限制。

Abstract
