我国农地使用权流转的历史考察
摘 要
我国农地使用权的流转是指独立于土地所有权的使用权的流转。我国农地使用权的流转大致经历了唐、宋以后至清末时期永佃权流转的萌芽与发展时期、民国到建国以前永佃权流转的定型时期及20世纪80年代初至今的土地承包经营权的流转时期。在不同的历史时期，我国农地使用权流转在立法和权利结构上呈现出各自的特点，同时他们又在地权的稳定与独立等方面存在1些共同点。我国当今土地承包经营权的流转应该在地权的稳定、立法与农村习惯的协调、流转方式多样化等方面吸取经验教训，完善我国现今的农地立法。

ABSTRACT
The transfer of the right to use of the Chinas agricultural land is a transfer independent of the land ownership. The transfer of the right to use of the Chinas agricultural land generally experienced the Emptyteusis transfer’s sprout and development period from Song, Yuan later to the end of the Qing time 、the Emptyteusis transfer’s stereotyped period from Republic to before founding of the nation and the transfer period of land contracting and operating right from 1980s to today. In different historical periods, The transfer of the right to use of the Chinas agricultural land have showed their own characteristics Right structure in Legislation and Right structure, at the same time, they also have the common ground in the land right of stable and independent Etc.
The transfer of land contracting and operating right in our Country’s today should study experience in the Land ownership stability、Legislation and Rural habits’s coordination、Transfer mode diversification Etc. Perfect our country agricultural legislation nowadays.
